Registration to carry out maritime transport activities

Regulations on the registration of ships owners/operators with the Angolan Cargo and Logistics Regulatory Agency (ARCCLA) are now in force.

The regulations require all owners/operators performing commercial cargo operations – foreign or local who may or may not have physical presence in Angola – to be registered with ARCCLA via a shipping agent.

Parties that do not own or operate vessels are not required to be registered with ARCCLA.

No deadline is set for the completion of registration. Registration could be on a case-by-case basis but must be initiated before arrival of any vessel of the concerned owner / operator.

The registration process could take 3-4 weeks to complete subject to all documents being submitted in good order.

If the ´Participation Card´ is not issued prior to vessel arrival, the request letter submitted to ARCCLA for registration which has been duly acknowledged would suffice.

Ship owners/operators can use the same ´Participation Card´ with multiple agents to prove the entity´s registration with ARCCLA on instances where a party’s registration is applied/completed by one agent and the owner/operator may have to use another agent based on Charterer’s instructions, and or vice versa.

Owners/operators not registered or who have not submitted for registration prior to vessel arrival will be fined USD 3000.00 per occasion.

If the registration process is already submitted and awaiting the ´Participation Card´ to be issued, there will be no penalties imposed.

There is no annual fee charged for renewal of the ´Participant Card´, however it was said during the meeting that this could have revisions in future at the discretion of the Ministry of Transport.

Loading Certificates for cargoes loaded from Angola must be obtained by the shipper or the respective terminal operator in the case of crude and petroleum products.

The regulations do not apply to vessels under Temporary Importation or for vessels calling Angolan ports under Force Majeure circumstances.
